Privacy Policy

This policy explains what information [Company Legal Name] ("we", "us") collects when you use SmartyPints TV (the "Service"), how we use it, and the choices you have. It covers businesses that subscribe ("Venues"), people who play trivia on their phones ("Players"), and the TVs that run our app.
The short version
- Players can play with just a nickname. Nicknames are shown publicly on that Venue's TVs and players' phones. The service-wide venue board shows Venue names and scores, not nicknames.
- An email address for Players is optional and is used only for sign-in and verification codes and account recovery.
- We do not sell or rent personal information, and we do not use it for targeted advertising.
- Gameplay data is deleted automatically after about 60 days.
1. Information we collect
Players
- Nickname you choose, the Venue you joined, and the date you played.
- Gameplay data: your answers, response times, points and rankings.
- Optional profile email: only if you choose to create a profile.
- Device and technical data: IP address, browser type, and request logs that our servers record automatically for security and troubleshooting.
- Browser storage: the player page saves a small session token in your browser's local storage so you stay in the game if you reload or your phone locks. See section 5.
Venues (account holders)
- Account details: name, email address, password (stored only as a secure hash), and the date you accepted our Terms.
- Venue details: venue name, timezone, logo, settings, custom questions, and uploaded ads.
- Billing: handled by Stripe. We receive a customer ID, subscription status, card brand and last four digits, but never your full card number.
- Support communications you send us.
TV devices
Each paired TV sends us: a random device identifier, the device model, the app version, its IP address, and a periodic "heartbeat" with its current status (for example, what it is showing and whether its content is downloaded). This lets Venues see that their TVs are online and lets us deliver games, ads and fixes. TVs do not have cameras or microphones enabled by our app, and we do not collect viewing data from other apps.
2. How we use information
- To run games: score answers, show leaderboards on the Venue's TVs and phones, and compile the service-wide venue board.
- To provide Venue accounts, deliver ads and music to TVs, and process subscriptions and payments.
- To send Players sign-in and verification codes and help them recover a profile, if they have given an email.
- To send Venues service messages (receipts, failed-payment notices, security and policy updates).
- To keep the Service secure, prevent cheating and abuse, and debug problems.
- To understand aggregate usage and improve the Service.
- To comply with law and enforce our Terms of Service.
We do not send Players marketing email, and we do not use Player data to target ads. Ads shown on TVs are chosen by the Venue by schedule, not by who is playing.
3. What is shown publicly
- Player nicknames and scores appear on the TVs at the Venue where you play and on other Players' phones at that Venue.
- Venue names and aggregate scores may appear on the service-wide venue board shown on TVs at other Venues (Venues can opt out of the board). Player nicknames are not shown there.
- Your email address is never shown publicly.
Choose a nickname that does not identify you if you prefer to stay anonymous.
4. How we share information
We share information only as needed to run the Service:
- Service providers acting on our behalf under contract: hosting ([Hosting Provider, e.g. DigitalOcean]), payment processing (Stripe), email delivery ([Email Provider]), and backup storage.
- Venues see the nicknames, scores and gameplay at their own Venue. They do not see Player email addresses.
- Legal and safety: when required by law or to protect the rights, safety and property of our users, the public, or us.
- Business transfers: in a merger, acquisition or sale of assets, subject to this policy.
We do not sell or "share" personal information as those terms are defined in U.S. state privacy laws, and we have not done so in the past 12 months.
5. Cookies and local storage

6. Data retention
- Gameplay data (rounds, player nicknames for a given night, answers and scores) is automatically deleted about 60 days after it is created.
- Player profiles (email) are kept until you delete your profile or ask us to, or after [24 months] of inactivity.
- Venue accounts and content are kept while the account is active and deleted within [90 days] after the account is closed, except where we must keep records longer (for example, billing and tax records, typically 7 years).
- TV device records are kept while the device is paired and removed when a Venue unpairs it or closes the account.
- Server logs and backups are kept for up to [30] days and 14 days respectively, then overwritten.
7. Security
We use encryption in transit (HTTPS), hashed passwords and tokens, access controls, and regular backups. No system is perfectly secure; if we learn of a breach affecting your personal information, we will notify you as required by law.
8. Your choices and rights
- Players: you can play without an email. You can delete your saved profile yourself from the Standings screen on the player page, or ask us to delete it or specific nicknames at any time.
- Venues: you can update your account in the portal, delete ads, questions and devices, and delete your account.
- Depending on where you live (for example California, Colorado, Virginia and other U.S. states, or the EU/UK), you may have the right to access, correct, delete, or receive a copy of your personal information, and to not be discriminated against for exercising these rights. EU/UK residents may also object to processing and complain to their data-protection authority.
To make a request, email support@smartypints.tv. We will verify your request (for example, by confirming control of the email address) and respond within the time required by law.
9. Children
The Service is intended for adults: 18 and older, and 21 or older (or the local legal drinking age) at Venues that serve alcohol. It is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, contact us and we will delete it.
10. International users
The Service is operated from the United States and our servers are located in [Region]. If you use it from elsewhere, your information will be transferred to and processed in the United States.
11. Changes to this policy
We may update this policy. We will post the new version here with a new "Last updated" date and, for material changes, notify Venues by email or in the portal.
